Issues concerning Dr. Sabina Burton’s personnel record

103.13(4) states “If the employee disagrees with any information contained in the personnel records, a removal or correction of that information may be mutually agreed upon by the employer and the employee. If an agreement cannot be reached, the employee may submit a written statement explaining the employee's position. The employer shall attach the employee's statement to the disputed portion of the personnel record. The employee's statement shall be included whenever that disputed portion of the personnel record is released to a 3rd party as long as the disputed record is a part of the file.”

On 8-22-17 Dr. Burton received a copy of her personnel record (PersFile-8-22-17).   Page numbers referenced below relate to this document.  To correct numerous errors & omissions Dr. Burton submits the following requests concerning her personnel file.

Hyperlinks in Dr. Burton’s online electronic documentation give ready access to supporting documents.  However, documents that have been printed on paper have been stripped of their associated hyperlinks.  Dr. Burton requests that her personnel file be immediately converted from paper files to a digital format that preserves hyperlinks.

Re-iteration of 12-31-16 request to correct personnel file:

A previous version of Dr. Burton’s personnel file had major problems and Dr. Burton requested that errors & omissions be corrected (PersFile-MajorProblems-12-31-16).  A few of her requests were addressed however, many were not.  Dr. Burton re-iterates those requests, and incorporates them below with more requests to correct errors and omissions in her personnel file.  

Note: some files are missing from the record that should be in place.  For example, the letter of recommendation for promotion and retention written by Chair Dr. Caywood on 1-29-12 is missing from the file.  It is here: (Caywood-rec-Sabina-Promo-1-29-12) and (Rec-Retention-Burton-1-27-11)

Burton to Shields email.  Request that he personally investigate her charges. Handwritten notes on Dr. Burton’s email seem to have been written by Chancellor Shields.  a) Shields writes in the margin that Dr. Burton’s claim that in 2010 Cheryl Fuller and Amy Nemmetz brought charges against Caywood were “not relevant and not fully informed.”  However, it does seem relevant that before Burton’s charges, Caywood was the subject of two previous sexual discrimination charges. b) Handwritten note says “Subject of …how complaint Tenured & Promoted” adjacent to the underlined word “retaliated.”  This seems to indicate that Chancellor Shields dismissed the retaliation because Burton was promoted and received tenure.  But the promotion was before the sexual harassment incident and the tenure was received before the grievance committee delivered its findings indicating that Caywood acted “poorly.”  This seems to be Shields’ attempt to discredit Burton’s complaints without evaluating the truth.  c) On pag 79 handwritten note says that the “Committee is working on this now” in response to Burton’s assertion that she had delivered an updated grievance package.  However, the updated package was ignored.  Updated gvnce referenced also on pg 80
