Concerning the inequity adjustment requested by Dean Throop on Mar 13, 2014:  (Public_Timeline – Mar 13, 2014)

 

Dr. Burton did not request the inequity adjustment.  It was requested by Dean Throop.

The administration seems to argue that an employee who is not discriminated against in pay cannot possibly be discriminated against in other ways.  This is not true. Pay is not the only way an employer retaliates against an employee. 

This inequity adjustment has been referred to on numerous occasions as a “raise” with the implication that it was given to Dr. Burton as reward for something.  However, there has never been any indication that this “raise” was anything but an adjustment to Dr. Burton’s deficient pay.  The adjustment did not bring Dr. Burton’s pay up to equity with Dr. Solar’s pay, even though Dr. Burton had several year’s seniority over Dr. Solar. 

This adjustment does not seem to be an attempt to reward for anything Dr. Burton had done.  It seems to be an attempt to reduce liability for the administration in court and to bribe Dr. Burton to be quiet, and drop her charges.

 

Letter in Personnel file indicating pay increase (Public_Timeline – Oct 16, 2014):

There is a letter in the personnel file obtained on 8-22-17 (PersFile-8-22-17-pg121).  Neither Sabina nor I ever saw this letter before 9-2-17.     

The letter says that the Joint Committee on Employment Relations (JCOER) approved a 2013-2015 pay plan for faculty and academic staff and non-represented graduate assistants, and univ senior execs were approved for a pay plan 1 pct pay adjustment on July 1, 2013 and on July 1, 2014. 

This is not a raise but an adjustment that everyone seems to have received.  Throop said that Sabina got two “raises” in the 5-25-17 kangaroo hearing, but this was not a raise it was an adjustment that apparently everyone got.  It doesn’t show that Sabina was being treated fairly but that maybe they didn’t discriminate against her in this way.  She never complained that they discriminated against her by not giving her this adjustment.   

   This letter shows $560 in a column marked “Merit.”  That is interesting since merit pay has not been paid to anyone in the department in the past several years, to my knowledge.  It is also interesting because during Oct 2014 Dean Throop was actively harassing Sabina and issued her infamous Letter of Direction on Oct 28, 2014, less than two weeks after this letter was signed by Chancellor Shields.

I did not see this letter in the court dockets in Sabina’s first lawsuit.  I didn’t see this letter in any of the arguments put forth by defense in that lawsuit.  Did it just appear recently?  Is it a forgery?  

Is it believable that Sabina got merit pay during the time she got the letter of direction?   Hmmm.   I think we would have remembered getting a letter like this at the time.  A review of the money actually paid to Sabina would probably shed light on this.

 

Let’s do some math:

On Mar 13, 2014 Dr. Burton’s pay was $52,268/yr, according to Dean Throop.  On that date she asked for an increase of $3,732/yr to bring Dr. Burton’s pay up to an even $56,000 per year (exhibit ZZD).    The adjustment was granted by the Chancellor on Mar 26, 2014 to be paid retroactively beginning Aug 19, 2013(exhibit ZZI).     

On July 1, 2014 the “Individual Equity Adjustment” should have increased Dr. Burton’s pay by 1% of her current salary of $56,000, or $560.  But her pay only increased by $440 for the Individual Equity Adjustment.   What happened to the other $120?  Hmmm. The administration seems to be playing games with Dr. Burton’s pay.

Why do the amounts of the adjustment and the amount for merit pay add up to an even $1,000?  It seems the amounts were adjusted to make Sabina’s pay a nice even figure.   When was Dr. Burton approved for merit pay? Where is the paperwork for that decision?  Why would she get merit pay when nobody else in the department seems to have received merit pay even though they were recommended for it?   Why didn’t someone inform Dr. Burton that she was to receive merit pay at that time?  Why wasn’t this letter included in the personnel file Dr. Burton received on 12/21/16 (PersFile-MajorProblems-12-31-16).   Was it written between 12/21/16 and 8/22/17 and post-dated to Oct 16, 2014.  Hmmm.
